STATEN ISLAND, NY (CBS) Patrick Timoney brought a gun to school Tuesday and nearly got suspended for it. Sounds reasonable until you see the gun – a two-inch LEGO toy gun.

Photo: LEGO toy that almost got Patrick Timoney suspended.

9-year-old Patrick, a fourth grader at PS 52 in Staten Island, N.Y., says he brought some of his LEGOs to school to show his friends during lunch but when the principal saw that one of those toys was a gun she pulled him out of class and called his parents.

A spokesman for the city's Department of Education says that the principal, Evelyn Matroianni, was just following the “no tolerance†policy of not allowing any weapons on campus.

Timoney’s mother, Laura Timoney, thinks the school overreacted.

"This isn't a safety issue," she said. "This is a judgment issue. I mean, what's the worst that could happen? It could poke you in the eye?"

Laura Timoney said Patrick was in tears when she got to the school and even asked to stay home from school Wednesday because he was afraid the principal was mad at him.

The toy gun goes with a policeman figure and is his favorite because his father, Pat Timoney, is a retired police officer.

And my faith in humanity decreases more.
It's not as if it was large enough to even look like it was genuine. I personally think the principal overreacted. It's a toy. A tiny toy that looks like a gun. If it looked like it could be a real gun, understandable. But a two-inch one? That principal is a moron.
Poor kid. He's going to feel intimidated until he leaves that school because of it.

Damn you're right there, they really overreacted, I mean like the mother said it will probably just poke someone in the eye in a worst case scenario.
The ironic thing is that the gun was actually off a toy policeman etc... So I don't think the kid would've used it to cause death by lego XD

What's the world coming to these days?

And THEN they wonder why kids go around shooting up schools. Well done America, well done.

This isn't as bad as what happened in England. A man was about to board a plane and he was told to turn his t-shirt inside out because there was the IMAGE of two guns on it. Apparently it could have offended other passengers >_>

This is why I'm not really looking forward to teaching. I don't want to have to deal with this kind of BS if I don't have to.

Besides, I've seen those little Lego guns...they don't even look like the real deal. C'mon. The worst that could happens is someone chokes on the thing, and that's because it's a friggin Lego, not a gun.

That's hilarious and ******ed. We've had a BB Gun shoot out of about 10 people in college a few times and there's not been any trouble, heck, one of them was even filmed xD
Though, it is America, so I expect no less from the news.

I can understand the policy part; think about a sec: If the teacher hadn't followed policy, the kid could very well HAVE poked a kid's eye out, and not only would there be much of a ruckus over the fact that a kid brought a toy gun, and the mother (not to mention the teacher) being harassed constantly by media/'victim's' parents (including some kind of lawsuit, because, hey, you gotta have one of those in every case study), but the teacher probably would have been sued, fired, and under much liability issues. Do I think she overreacted? Yes; she could've just asked the kid, politely even, to come with her, and explain the situation, before calling the parents, downsizing this situation completely, and maintaining the kid's self esteem. But, unfortunately, things didn't go so well, and this is the result.

Probably cannot happen either, those things are so small you'll swallow them whole.

And my faith in America goes down the toilet again.

What harm could a rainbow colored 2-inch gun do...?
That's besides the point though. It's sickening to see what our society is becoming. It's safe to say that in our effort to correct poor morals, instead we make a much larger problem then there already is. You can't blame a child his age to not form that thought that a gun is a weapon, unless the child has confronted actual weapons, I do not think that is fathomable is his mind.
You honestly can't expect children to know adult things, enough said.

When I was your age, if our pencils broke, we walked 15 feet both ways to a grinding pencil sharpener and turned the crank to get a point back on the tip. We didn't have any of those newfangled "mechanical" pencils. You young whippersnappers don't know how good you have it.

    XD Sorry, couldn't resist.
