Is drunk sex rape?

    If consent is given at any point, despite a loss in judgement, the sex is considered consensual. When one drinks to excess, they take into account the loss in ability to judge and are still responsible for anything they do while drunk. So if a woman gets drunk and then has consensual sex, it's legal. If a woman gets drunk and has non-consensual sex, it's rape. If a woman gets drunk, falls unconcious without giving permission and is raped, it is rape. Likewise, if I kill someone when drunk, I cannot use the drunkeness as a defense, because I chose to get drunk.

    I like this comparison. Anything you do while drunk cannot be defended by the fact that you are drunk, including consenting to sex.

    Now if the woman was so drunk that she couldn't even speak to consent, but had sex anyway because she was so drunk, I think that can be considered rape, if the other party was sober.

    If no consent is given, it's rape, as always. Drunkenness doesn't change that one bit. Even if the other party is drunk, if no consent is given, it is still rape. Remember, the other party doesn't get any special treatment just because it's drunk.

    I mentioned that because they did an episode talking about this exact issue and I didnt necessarily agree/disagree with the way they presented it. And actually if you sat down and watched carefully degrassi, while melodramatic as hell actually has a lot of factual info in it.
