http://www.wired.com/threatlevel/2010/02/obscene-us-manga-collector-jailed-6-months/ Is this right? Should this guy be in jail?
I think that law is ridiculous. Who is to say something doesn't have “serious literary, artistic, political, or scientific value”? As long as an actual child or someone getting hurt isn't involved, I'm fine with whatever turns you on. Even I have some shota saved on my computer, does that automatically make me a child predator? I heard somewhere that James Cameron's next picture will involve a nude girl, in which he will use photo-realistic CGI to depict to avoid child protection laws.
For the real stuff, yes. For the mangas and whatnot, no. It's gross, but it's ART. Isn't that stuff legal under the US Constitution as long as it's drawn?
If they are implying that illustrated images involving child sex encourages pedophilia then they will have to ban any illustration involving an illegal act. There goes most cartoons.
Very true, I mean isn't the freedom of expression allowed within the Constitution? Drawing is expression as is writing or speaking.
The news article was pretty odd. But yeah, doesn't manga constitute as art? So it has child pornography in it and is artistically presented. It's really all determined by the beholder if it is art or not. -shrugs-
Yeah, really no point in debating it here. It's obvious that man has been wronged, but the law wont change if people don't do something about it.
True i dont think he should be jailed for having a few manga on child sex and bestiality (?) and from that amount of manga not all of em are going to be child sex/bestiality(?) on another note.... So Much MANGA!!! immag go steal his stuff.
That's his collection of hentai porn?!?! My hero! But to be honest that law is completely ignorant. 8730 said it right. If this was even a 'crime' it is the very definition of victimless. This guy is said to hold paedophillic items, yet it's only pencil drawings and paint at the end of the day. I bet the characters ages aren't even specified, so conclusions are jumped to.
Well, this certainly makes us question the term "victimless crime". I'm gonna agree with the constitutional argument point though, this kind of stuff is just... I can see why there's an outrage from the manga fans, but, at the same time I can see why the guy was arrested. Let's be honest, a collection that size (If it contains what it is claimed to contain) is enough to arouse suspiscion at least. Full blown arrest though? However, I must make the point that if it is legal for them to be mass printed and also shipped internationally, then surely it is legal for them to be read. This is probably hugely misguided, and I'm fairly confident that someone will prove me wrong, but that's the way I see it.
Agreed. Except, I'm not angry that this guy has possibly shota & lolicon manga in his room. I'm just surprised this guy is STUPID enough to order this crap from Japan and not expect to be caught. Least he could do is just download that stuff on his computer FOR FREE and call it a day, instead of spending money on something you have to wait for a few weeks to recieve and getting sent to jail for it.
That may be the most stupid thing I've ever read. SERIOUSLY? He's going to be arrested for art? What makes me angry is that this law is so centered on opinion. It's their opinion that it's "not contributive". That man was jailed because of opinon. That is the crime.
